Terms Of Service

Use

Our services can be used for anything permitted by Norwegian law. Use we do not allow is as listed, but not limited to;

  • DoS, DDoS or amplification attacks
  • IP spoofing
  • Send spam email or distribute malware
  • CPU/GPU-mining and storage plotting of crypto currency
  • Hosting of phishing sites
  • Use of cracked or unlicensed software
  • Mass port scanning
  • Tunnels to other locations with the express purpose of providing remote DDoS protection
  • Intellectual property infringement

Should one of your services violate any of these terms, they may be terminated. Terrahost may without notice choose to suspend or close the service in the event of breach of the above terms.

Money back guarantee

We offer a 7-day money back guarantee if your services are not as they should be and are included in one of the following scenarios:

  • Network outage lasting longer than 3 hours
  • Power outage lasting longer than 4 hours
  • Replacement of defective hardware component, which takes longer than 48 hours

Invoice and cancellation

Any service that has outstanding invoices after 14 days will automatically be terminated midnight on day 15. This will result in the loss of all data on the service. If you have any special needs, please contact us so that this time limit can be extended.

All cancellation requests must be made through our current customer pages, not directly by email. Cancellation of a service will automatically credit outstanding bills for the service that has not yet passed due date. The service will then be removed from your account after the current billing cycle. Cancellations can be aborted at any time by contacting support.

Any unpaid service is suspended after 7 days. The service is terminated after another 7 days and the account can no longer order new services.

To reopen og restore cancelled services which have been removed or deleted due to non-payment, we charge a fee of $100 excl VAT.

By associating your card, or your PayPal account as a payment method, you allow us to charge outstanding bills to your account.

Invoices paid via bank transfer and/or EHF has a fee of $3 excl VAT. By using either card or PayPal you avoid this fee.

Payments from sanctioned jurisdictions

We are not able to accept payments from sanctioned jurisdictions, or from companies or exchanges operating in these regions. This is, but not limited to: Cuba, Iran, North Korea, Russia and Syria.

Bandwidth Usage

All services are delivered with a predefined amount of bandwidth. Services could be suspended if they exceed the allocated bandwidth volume. Extra bandwidth can be purchased at any time. Servers with an unmetered plan are subject to our Fair Usage Policy. On our dedicated servers the ports are shared with other customers (3.2:1 ratio) and normal usage is expected. Your use should not cause problems for other customers or infrastructure.

For dedicated servers, usage beyond 10% (1Gbps) continuous use of the port's capacity on 10Gbit is considered overusage and you may be asked to upgrade to a dedicated port.

For virtual servers, usage beyond 10% (1Gbps) continuous use of the port's capacity on 10Gbit is considered overusage and you may be asked to upgrade to a dedicated port.

Terrahost reserves the right to limit bandwidth on a service to keep QoS or to avoid abuse.

Virtual server resources

For virtual servers, sustained CPU usage exceeding 35% over an extended period is not allowed. However, we place no restrictions on short-term bursts of higher usage. Should your CPU consumption consistently surpass the 35% threshold, we will inform you and recommend transitioning to a dedicated server for optimal performance.

Overages

Unless agreed otherwise we will charge for bandwidth overages at the following rates. $2 per TB for dedicated and virtual servers with a metered bandwidth limit, and $0.5 per Mbps over the 95th % limit for servers with an unmetered (FUP) plan. Pricing are excl VAT.

S3 Object Storage free egress policy

Our free egress policy is designed for cases where you access your data at a reasonable rate and your usage does not impose an unreasonable burden on our service. We allow egress transfer which is two times the size of your stored data volume, with a minimum of 1TB. This means if you store any amount up to 1TB, available egress bandwidth per calendar month is 2TB. If you store for instance 10TB, your available egress bandwidth is 20TB.

Transfers between our S3 Object Storage and Terrahost dedicated servers in the same region are exempt from this rule, but subject to the dedicated servers fair usage policy on bandwidth, or any other bandwidth agreements you have on your server. This exemption does not apply to virtual servers.

Tor Exit Node

Terrahost allows customers to operate Tor Exit nodes on our network with the restrictions listed below. A Tor Exit node can use a lot of bandwidth and cause you to exceed your included bandwidth volume. Additional bandwidth is charged at current rates.

  • The server must have a website stating that it operates a Tor Exit node
  • The server must have a recognizable Reverse DNS that shows it operates a Tor Exit node
  • The server must use a reduced exit policy as described on this link: https://terrahost.com/tor-exit-policy
  • You must contact support before you setup your Tor Exit node
  • Tor Exit nodes are only permitted on dedicated servers

Limitation of liability

Terrahost can only be held responsible for damages caused by gross negligence or intent. Loss as a result of reduced or halted production or sales is not something Terrahost is liable for. Any claim cannot exceed the amount Terrahost has invoiced the customer for the service during the current billing period.

Data loss and hardware replacement guarantee

We do not keep backups of your services. You are responsible for the backup of your data and the integrity of these. Terrahost is not liable in case of loss of data. We recommend that all customers maintain adequate backups at all times. Services that this concerns are, but are not limited to:

  • Virtual server
  • Dedicated server
  • Shared hosting
  • Colocation
  • Email services

Should a hardware component fail, we will replace the defective component as soon as possible or within 48 hours.

Force Majeure

If the execution of the agreement is wholly or partly prevented or substantially hampered by circumstances beyond the control of the parties, the parties' duties are suspended to the extent that the relationship is relevant and for as long as the relationship persists. Such conditions include, but are not limited to, strike, lockout, third party error, third party power failure, and any circumstance that will be judged as force majeure.
